As a healthcare provider, the Company collects health information including:

  • Sleep apnea diagnosis and medical history
  • Symptoms and health conditions (snoring, breathing interruptions, daytime fatigue)
  • Sleep study results and diagnostic test data
  • Treatment information and progress notes
  • Insurance information
  • Date of birth and health identifiers
  • Prescription and medical device information

Important: Health information governed by HIPAA is managed under business associate agreements with affiliated professional entities, not solely this privacy policy.

Usage Data

Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

SMS / Text Messaging Program

theREALsleep operates an SMS text messaging program to communicate with patients and prospective patients who have provided express written consent to receive text messages from us. By submitting your mobile phone number through one of our online forms and checking the SMS opt-in box, you agree to receive text messages from theREALsleep at the number you provide.

Program Purpose and Message Types

Message content may include:

  • Appointment reminders, confirmations, and scheduling
  • Follow-up and care communications related to your sleep test or treatment
  • Account and billing notifications
  • Responses to inquiries you submit through our website
  • Occasional promotional offers, educational content, and service updates (only if you opt in to marketing messages)

How to Opt In

You may opt in to receive SMS messages by submitting the contact form, the free sleep assessment, or any other online form on our Website in which you check the box indicating you agree to receive text messages at the phone number you provide. SMS opt-in is always optional, is never pre-checked, and is never a condition of scheduling an appointment, receiving care, or purchasing a product or service.

Message Frequency

Message frequency varies based on your interaction with us. You will typically receive no more than a handful of messages per month in connection with appointments or inquiries. Promotional message frequency, if you have opted in, will not exceed a reasonable cadence.

Message and Data Rates

Message and data rates may apply depending on your mobile carrier and plan. theREALsleep is not responsible for any charges assessed by your wireless carrier.

How to Opt Out

You may opt out of receiving text messages from us at any time by replying STOP to any message you receive from theREALsleep. After replying STOP, you will receive one confirmation message and will not receive any additional text messages from us unless you opt back in. Supported Carriers

Our SMS program is supported by most major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.

No Sharing or Sale of Mobile Information

We do not share, sell, rent, or otherwise disclose your mobile phone number, SMS opt-in status, or the contents of any SMS conversation with any third parties or affiliates for their marketing or promotional purposes. Information obtained as part of the SMS consent process will not be shared with third parties for marketing purposes. We may share this information only with service providers (such as our SMS messaging platform) that help us operate the program, and only to the extent necessary to deliver messages to you. This limitation does not apply to disclosures required by law or to disclosures made with your separate consent.

Privacy of SMS Communications

Please do not include sensitive personal health information, financial information, or other confidential information in any text message to us. Standard text messages are not a secure channel for transmitting Protected Health Information (PHI). For secure communications related to your care, please contact us by phone or through a secure patient portal if one is made available to you.

Payments

We do not store credit card details. Third-party payment processors handle payments under PCI-DSS standards.
