Welcome to Real Sleep.
These Terms of Use (“Terms”) govern your access to and use of the Real Sleep website located at www.therealsleep.com, all affiliated websites, patient portals, mobile applications (if applicable), digital platforms, and any products or services offered through those platforms (collectively, the “Services”).
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, you should not access or use our Services.
1. About Real Sleep
These Terms apply to services provided by theREALsleepMEDICAL, LLC, doing business as Real Sleep (“Real Sleep,” “Company,” “we,” “our,” or “us”).
Real Sleep is a healthcare company dedicated to improving the diagnosis, treatment, and long-term management of obstructive sleep apnea and related sleep disorders through technology-enabled care and collaboration with licensed healthcare professionals.
Clinical services made available through Real Sleep are provided by independently licensed physicians, sleep medicine providers, and general dentists, who exercise their independent professional judgment within the scope of their respective licenses.
Real Sleep facilitates access to these providers and supports patients throughout their treatment journey but does not direct or control the independent clinical judgment of any licensed healthcare professional.
2. Acceptance of These Terms
By using our Services, you represent and warrant that:
- you are at least eighteen (18) years of age;
- you reside within the United States;
- you have the legal authority to enter into this agreement;
- all information you provide is truthful, accurate, and complete;
- you will comply with these Terms and all applicable laws.
If you are using our Services on behalf of another person, you represent that you have legal authority to act on that person’s behalf.
3. Changes to These Terms
Real Sleep may update or modify these Terms at any time to reflect changes in our business, applicable laws, technology, or Services.
When changes are made, we will update the “Last Updated” date at the top of this page.
Your continued use of the Services following publication of revised Terms constitutes your acceptance of those revisions.
If you do not agree with any modified Terms, you must discontinue use of the Services.
4. Medical Emergencies
REAL SLEEP IS NOT AN EMERGENCY MEDICAL SERVICE.
Our website, patient portal, email communications, text messaging services, and customer support are not intended for emergency medical situations.
If you believe you are experiencing a medical emergency, including but not limited to:
- chest pain
- severe difficulty breathing
- stroke symptoms
- loss of consciousness
- suicidal thoughts
- any condition requiring immediate medical attention
Call 911 immediately or seek care at your nearest emergency department.
Real Sleep does not continuously monitor communications submitted through our website or patient portal and cannot guarantee immediate responses.
5. Medical Disclaimer
Information available through our website—including articles, videos, educational materials, blog posts, FAQs, downloadable resources, marketing materials, emails, social media content, and other educational content—is provided solely for informational and educational purposes.
Nothing contained within our Services constitutes:
- medical advice;
- dental advice;
- diagnosis;
- treatment recommendations;
- establishment of a physician-patient relationship;
- establishment of a dentist-patient relationship.
Only a licensed healthcare provider who has evaluated your specific circumstances can determine the appropriate diagnosis or treatment recommendations.
You should never disregard professional medical advice or delay seeking treatment because of information obtained through our Services.
6. Independent Healthcare Providers
Real Sleep works with independently licensed physicians, sleep medicine providers, and general dentists.
These healthcare professionals are solely responsible for:
- evaluating patients;
- making clinical decisions;
- determining medical necessity;
- prescribing treatment when appropriate;
- monitoring patient progress;
- providing follow-up care within their professional judgment.
Nothing contained within these Terms shall be interpreted as creating an employer-employee relationship between Real Sleep and any independently practicing healthcare provider.
Clinical decisions remain exclusively within the judgment of each licensed provider.
7. Telehealth Services
Certain Services may be delivered through telehealth technologies, including secure video consultations, telephone consultations, asynchronous communications, electronic messaging, and remote review of diagnostic information.
By using these Services, you acknowledge that:
- telehealth has inherent limitations;
- technology failures may occur;
- certain conditions may require in-person evaluation;
- your provider may determine that telehealth is not appropriate for your situation;
- your provider may refer you to an in-person healthcare provider at any time.
You consent to receiving healthcare through telehealth when offered and when clinically appropriate.
Separate Telehealth Consent forms may also apply.
8. Home Sleep Testing
Real Sleep may facilitate home sleep testing (“HST”) through FDA-cleared diagnostic devices prescribed or ordered by appropriately licensed healthcare providers.
Completion of a home sleep test does not guarantee:
- a diagnosis;
- eligibility for treatment;
- insurance coverage;
- issuance of a prescription;
- recommendation for an oral appliance.
All diagnostic decisions remain solely within the independent judgment of your treating provider.
9. Oral Appliance Therapy
If prescribed by your treating provider, your treatment may include a custom oral appliance designed specifically for your dental anatomy.
Custom oral appliances:
- require either an at-home impression kit or approved digital intraoral scan;
- are prescription medical devices;
- are manufactured specifically for an individual patient;
- cannot be reused, resold, or transferred;
- are subject to the Real Sleep Return Policy and Patient Care Guarantee.
Treatment outcomes vary between individuals.
Real Sleep cannot guarantee that every patient will achieve complete resolution of symptoms or identical treatment results.
10. Eligibility
Our Services are intended solely for individuals eighteen (18) years of age or older residing within the United States.
By accessing our Services, you represent that you satisfy these eligibility requirements.
We reserve the right to deny access or discontinue Services where permitted by law.
11. Patient Responsibilities
By using our Services, you agree to:
- provide complete and accurate health information;
- promptly update any changes to your medical history;
- follow instructions provided by your treating provider;
- properly complete any home sleep testing or impression kits;
- attend scheduled appointments when applicable;
- promptly notify us if your contact information changes;
- maintain the confidentiality of your patient portal credentials;
- comply with all applicable laws.
Failure to provide accurate information may affect your eligibility for treatment.
12. Account Registration
Certain Services require creation of a secure patient account.
You agree to:
- maintain accurate account information;
- keep your password confidential;
- immediately notify us of unauthorized account access;
- accept responsibility for all activity occurring under your account.
Real Sleep reserves the right to suspend or terminate accounts that violate these Terms or applicable law.
13. Acceptable Use
You agree not to:
- violate any law;
- interfere with the operation of our Services;
- upload malicious software;
- attempt unauthorized access;
- impersonate another person;
- misuse patient information;
- copy or reproduce our content without written permission;
- interfere with another user’s experience.
Violation of this section may result in immediate suspension or termination of access.
14. Intellectual Property
All content made available through the Services—including but not limited to the Real Sleep name, logos, trademarks, service marks, designs, website content, educational materials, videos, graphics, software, downloadable resources, treatment protocols, blog articles, photographs, marketing materials, audiovisual content, and proprietary workflows—is owned by or licensed to Real Sleep and is protected by United States intellectual property laws.
Except as expressly permitted in writing, you may not:
- reproduce;
- distribute;
- modify;
- publish;
- display;
- create derivative works from;
- commercially exploit; or
- reverse engineer
any Real Sleep intellectual property.
Unauthorized use may result in legal action.
